PROMOTION DESCRIPTION: The "Controllermodzau Giveaway" will commence on September 26th, 2023 and conclude on November 10th 2023 AEST.
This sweepstakes is sponsored by Controllermodzau. By participating in the sweepstakes, each entrant unconditionally agrees to abide by these Official Rules and acknowledges that the decisions made by Sponsor are final and binding in all aspects. Sponsor is responsible for the collection, submission, or processing of Entries and the overall management of the Sweepstakes. Any inquiries, comments, or issues related to the Sweepstakes should be directed solely to Sponsor, contactable via email at info@controllermodzau.com.au during the Promotion Period.
ELIGIBILITY: The Sweepstakes is open to both international and national legal residents. Entrants must be 18 years of age or older as at the date of entry in order to be eligible to enter the competition or the parent must provide the consent to the sweepstakes rules. Employees of Sponsor, its parent companies, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies, and each of their officers, directors, and employees (collectively, the "Promotion Entities") are ineligible to participate or win. Individuals classified as "Household Members" and "Immediate Family Members" of the aforementioned individuals are also not eligible to enter or win. "Household Members" refers to those individuals who share the same residence for at least three months a year, while "Immediate Family Members" include parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law.
HOW TO ENTER: To enter the Sweepstakes during the Promotion Period, visit the entry form available at https://controllermodzau.com.au/giveaway/modern-warfare-3-ps5-giveaway. Automated or robotic submissions from individuals or organisations will be disqualified. Entrants must personally complete the online entry. Any attempt to obtain more Entries than the specified limit using multiple/different email addresses, identities, registrations, logins, or any other methods, including commercial contest/sweepstakes subscription notifications and/or entering services, will result in the disqualification of all Entries. All Entries must be submitted before the Promotion Period's end, with Sponsor's database clock serving as the official timekeeper.
WINNER SELECTION: The Winner(s) of the Sweepstakes will be randomly selected from all eligible Entries received during the Promotion Period. The random drawing, conducted by Sponsor or its designated representatives, will take place approximately within 7 days after the Promotion Period ends. The odds of winning depend on the number of eligible Entries received.
WINNER NOTIFICATION: The Winner will receive an email notification at the email address provided in the Entry Information, approximately within 7 days after the random drawing. The potential Winner must accept the prize as directed by Sponsor via email within 7 days of notification. Sponsor is not responsible for any delay or failure in receiving notifications for any reason, including inactive email account(s), technical difficulties, or the Winner's failure to check their email account. Failure to respond to the winner notification or returned notifications as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility, release of liability, and a Publicity Release (collectively, the "Prize Claim Documents"). Except as permitted by Sponsor, no substitution or transfer of the prize is allowed.
PRIVACY: Any personal information provided by Entrants will be subject to Sponsor's privacy policy, available on the Sponsor's website. By participating in the Sweepstakes, Entrants grant Sponsor permission to share their email address and any other personally identifiable information.
LIMITATION OF LIABILITY: By entering, you agree to release and hold harmless Controllermodzau and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, including: (i) your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any prize or any part thereof; (ii) technical failures of any kind, including, but not limited to, the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorised human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
DISPUTES: This Sweepstakes IS GOVERNED BY THE LAWS OF Australia, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES. As a condition of participating in this Sweepstakes, participants agree that any disputes that cannot be resolved between the parties and any causes of action arising out of or connected with this Sweepstakes will be resolved individually, without resort to any form of class action. Furthermore, participants hereby waive any right to seek punitive, incidental, or consequential damages, including reasonable attorney's fees, in any such dispute. Participants also waive any right to have damages multiplied or increased.

Requests for the names of the winners must be received no later than 30 days after the Promotion Period has ended.
